All Naturopaths at AIM Natural Healthcare are not within the ambit of the Australian Health Practitioners’ Regulation (AHPRA) and therefore must follow the Code of Conduct outlined by the our registered association; National Herbalists Association of Australia (NHAA) and the Unregistered Health Practitioners Code of Conduct.

SPECIFIC DISCLAIMER

Practitioners are fully qualified in their field and meet the requirements of their Association and insuring bodies. Our practitioners will do our very best to support you on your health journey, however every individual is unique and responds to treatment differently due to factors such as compliance, genetics, diet, lifestyle, environment, other medications and emotional status. It is not possible to guarantee clinical outcomes and timelines. Furthermore, there may be times where your health needs may sit outside our scope of practice, and we will refer you to a suitable modality.

It is your responsibility to disclose full and accurate information about your health history including diagnosed medical conditions, medications or supplements, known allergies and intolerances. This is to ensure safety of treatment and check for pharmacological interactions with any herbs or nutrients prescribed. It is also your responsibility to notify us and your other health practitioners of any new prescribed treatments, supplements, pregnancy status, products or medications to ensure safe integrative care. It is a safety issue if you do not declare all medication and supplementation or your pregnancy status.

If you experience an unexpected reaction to a prescribed product, please notify us as soon as possible. If you experience life threatening symptoms such as anaphylaxis, please call 000 immediately.

Products prescribed to you are not to be shared with others such as family members or friends. We encourage people to seek personalised advice from a qualified health professional prior to self-prescription to ensure safety and efficacy of treatment.

PAYMENT TERMS

All quotes and payment is made in Australian dollar currency. We take payments via Latpay for consultation fees and some prescriptions. Please view their website for their privacy policy and terms & conditions. In some cases we may take electronic bank transfer as payment.

Refunds are not available for services. However, in the event you are not satisfied, please contact us.

CANCELLATION POLICY

You will be sent an SMS reminder 48hours prior to your scheduled appointment. Cancellations and or rescheduling are made through your patient portal.

Cancellations within 24hours of your scheduled appointment incurs 50% of your total appointment fee. Failure to show up to your scheduled appointment will incur 100% your total consultation fee. If you feel that a cancellation fee has been unfairly issued, please get in contact with us.

You have the right to terminate your consultation at any time. However, you may be required to pay in full for your consultation.

CONSUMER GUARANTEES

In the event of a minor issue, we will do our best to find an appropriate resolution as soon as practicable. Such issues include:

• Internet issues or power outages during an online consultation (please ensure that you have stable internet connection before booking and attending a consultation to avoid inturruptions).

• If there is an issue with any of our third party client management and booking systems.

• If you are unable to access and download documentation or treatment plans.

• Issues with email communication.

• If an incorrect product was dispensed, or there was an issue with a product dispensed through us. However, if an incorrect product was dispensed, or there was an issue with a product sent through a third party company, please refer to their terms and conditions prior to engaging with their service and contact them directly for resolution.

SHIPPING

You may be prescribed herbal medicines, supplements, and/or essences within a consultation. These may be dispensed directly through your practitioner or through a third party (who will send products directly to you or which you can pick up from) upon payment of your prescription. A postage charge may be issued, which will be disclosed to you at the time of payment.

We are not liable for any delayed, missing or appropriately packaged parcels damaged during transit while sent through our couriers, Australia Post or any third party prescription services. Please refer to the shipping and delivery terms of service on any third party prescription services utilised.

PURCHASER’S DISCLAIMER

It is your responsibility to ensure that the Courses and/or any Products are sufficient and suitable for your purposes and meet your individual requirements.

We do not warrant that the Courses and/or any Products will meet your individual requirements.

Notwithstanding the fact that you may be able to tailor some aspects of the Courses and/or any Products to your needs, you expressly acknowledge that the Courses and/or any Products are standard and not made bespoke to fit any particular requirements that you may have.

You acknowledge that participation in the Courses assumes that the participant does not suffer from any health conditions.

If you suffer from a health condition, you must consult a health care or medical professional before commencing the Courses and/or using any Products, and must conduct the remainder of the Courses and/or any further usage of the Products under the guidance of a qualified health care or medical professional. If you register for, purchase and or use or commence the Courses and/or the Products prior to consultation with a health care or medical professional you do so at your own risk and therefore take sole responsibility for the outcomes or affects of doing so.

You hereby disclaim any right to rescind, or cancel the Agreement or to sue for damages or to claim restitution arising out of any misrepresentation made to you by Amy Makejev + AIM Natural Healthcare or any servant or agent of Amy Makejev + AIM Natural Healthcare and you acknowledge that you use the Website and/or purchase the Courses and/or any Products relying solely upon your own skill and judgement and (if applicable) that Amy Makejev + AIM Natural Healthcare shall not be bound by nor responsible for any term, condition, representation or warranty other than the warranty given by the manufacturer of the Courses and/or any Products (where applicable) which warranty shall be personal to you and shall not be transferable to any subsequent purchaser.

LIMITATION ON LIABILITY & INDEMNITY

In no event shall Amy Makejev + AIM Natural Healthcare be liable to you or any third party for any loss, damage or claim in connection with their use of the Website, even if Amy Makejev + AIM Natural Healthcare has been advised of the possibility of such.

In the event of any breach of this Agreement by Amy Makejev + AIM Natural Healthcare the remedies to you shall be limited to damages.

Under no circumstances shall the liability of Amy Makejev + AIM Natural Healthcare exceed the price of the relevant Courses and/or any Products paid by you.

You agree to indemnify and hold Amy Makejev + AIM Natural Healthcare, its subsidiaries, and affiliates, and their respective officers, agents, advisers, representatives, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of our services and/or the Website in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above.

Amy Makejev + AIM Natural Healthcare shall be under no liability whatever to you for any indirect loss and/or expense (including loss of profit) suffered by you arising out of a breach of this Agreement.
